The DBA Act

The pilot of the web module is the only remaining measure within the replacement of the DBA Act. Since a lot has happened in recent years, we list all the important developments and changes for you.

REPLACEMENT OF THE DBA ACT

The DBA Act has not brought the clarity and tranquillity that was intended. In May 2016, the Declaration of Independent Contractor Status (VAR) was dropped and the introduction of the DBA Act was approved. From then on, the principal and contractor could use special model contracts to shape the employment relationship. It soon became clear that the introduction of the DBA Act caused unrest and confusion among both the client and the contractor. The Cabinet then decided to replace the Act.

The pilot of the web module

The replacement plans for the DBA Act have changed constantly in recent years – for various reasons. In January, the pilot web module was launched. In the pilot phase, the web module serves as an information tool for clients to obtain clarity on the qualification of an employment relationship. During the pilot it can be tested whether the web module is helpful in practice for clients who need more clarity regarding the qualification of an employment relationship. After the pilot phase, a decision will be made regarding the continuation of the web module.
